On public transport organization

On 26.08.2009 a news programme broadcasted by the “Kentron” television reported that organizations and private entrepreneurs, registered in the Republic of Armenia and offering transportation services for a fee on a large scale contravene the requirements of the RA Labor Code; drivers of the general public transport suffer from the violation of their Right to Rest and Leisure and the Right to Just and Favourable Remuneration; particularly peculiarities of labor and rest, stipulated by the Appendix N6 of the Government Decision from February 1, 2007 N 201-Ն are left out of account.
During the examination carried out by the State Committee of Labor it was revealed that corresponding organizations employ considerably less number of drivers than it is required by the RA Labor Code.
Consequently, the main reason for the present situation is the pursuit of the corresponding organizations to gain super-profits by employing less people, which is possible only in terms of the absence of a free market.
In the result of the aforementioned legal breaches not only the labor rights of the drivers of general usage transport are being violated, but also there appears a real threat to the security of the population.
Referring to the above-mentioned the RA Human Rights Defender calls upon competent state bodies to take active steps to absolute implementation of the requirements of the RA Labor Code considering of paramount importance the elimination of the conditions contributing to legal violations.
